High Court Case Filed Against Anti-Defection Act

A case has been filed in the High Court seeking the annulment of several provisions in the Anti-Defection Act.

According to the High Court, the case was submitted by a private individual, though the specific provisions under challenge have not yet been disclosed.

The Anti-Defection Act mandates that Members of Parliament (MPs) elected through a political party must resign their seats within seven days if they leave their party, join another, or if an independent MP joins a political party. However, the Act does not specify consequences for MPs who fail to comply with these requirements.

The Act also outlines similar resignation requirements for members of island councils, city councils, and atoll councils under certain circumstances.

The case highlights a lack of clarity in the law regarding enforcement, raising questions about the effectiveness of the provisions.
